Preparing for the Hearing Stage of a Social Security Disability Claim

If your Social Security Disability claim has been denied at both the initial application and reconsideration stages, your next step is to request a hearing before an Administrative Law Judge (ALJ). This is a critical stage in the appeals process—and often your best chance at securing the benefits you deserve.

What Is the Hearing Stage?

The hearing stage is the third level in the Social Security Disability process. If you were denied during reconsideration, you can file a Request for Hearing with the Social Security Administration. You must do this within 60 days of receiving your reconsideration denial.

Unlike the earlier stages—which are mostly paperwork reviews—this is your opportunity to present your case in person (or via video or telephone) before a judge. It’s also your chance to explain, in your own words, how your condition prevents you from working.


What Happens at the Hearing?

Your hearing will take place at a local Office of Hearings Operations (OHO) or may be held via video teleconference or phone, depending on SSA scheduling and your location.

During the hearing:

An Administrative Law Judge (ALJ) will review your case and ask you questions about your medical conditions, symptoms, work history, and daily life.
Your attorney will represent you, present evidence, and question witnesses.
A vocational expert may testify about what jobs—if any—you can still do based on your limitations.
In some cases, a medical expert may provide input based on your records.


You don’t need to prove you’re completely bedridden—only that you’re unable to work full time due to a medical condition that has lasted or is expected to last at least 12 months.
